New Jersey has one of the toughest laws in the nation for driving while intoxicated. A key element in the prosecution of a drunk driving case is establishing the blood alcohol concentration (BAC) of a suspected drunk driver. In limited instances a person’s blood may be sampled to determine its BAC level. However, for most suspected drunk drivers, New Jersey law allows the BAC level to be determined by the indirect measure of breath testing which calculates the alcohol concentration in a person’s breath and uses that information to determine a blood/breath ratio.
